Terms of Service for Japale
Version: 1.0 (Effective: May 2026)
Welcome to Japale, the World’s First Devotees Social Network. These Terms of Service ("Terms") constitute a legally binding agreement between you and Sewak Community ("Company", "we", "us", or "our") concerning your access to and use of the Japale mobile application.
1. Binding Acceptance
Acceptance of these Terms is obtained through explicit, affirmative action (such as checking an unticked box) during account registration, in strict compliance with the DPDP Act 2023. Material changes will require fresh explicit consent.
If you do not agree with any part of these Terms, you are strictly prohibited from using the application and must discontinue use immediately. This document serves as a formal and legally binding contract governing your use of our platform.
2. Absolute Moderator Discretion (Zero-Tolerance Policy)
Japale strictly operates as a 'Zero-Tolerance' platform to preserve the sanctity of our devotee ecosystem. We maintain Absolute Discretion to monitor, review, and moderate any content submitted by users—including but not limited to posts, comments, private messages, or profile information.
In strict compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, users must not host, display, upload, modify, publish, transmit, store, update or share any information that belongs to another person, is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, threatens the unity, integrity, defense, security or sovereignty of India, or violates any current law.
If our internal review determines a violation of our community guidelines or these Terms, Japale reserves the exclusive right to take immediate, irrevocable action. This includes permanent account termination, content removal, IP blocking, and permanent hardware device bans (via Android Device ID), without providing any prior notice, explanation, or right of appeal.
3. User Waiver of Litigation
You hereby explicitly waive any right to sue, initiate class-action lawsuits, or claim damages, loss of data, or emotional distress resulting from account termination or content removal. You agree that any account ban or content moderation decision made by the Japale administration is final and not subject to judicial review. However, while platform moderation decisions are final, this does not affect your statutory rights to approach the Data Protection Board of India (DPBI) or competent authorities for data-related grievances under the Digital Personal Data Protection (DPDP) Act, 2023.
4. No Compensation & Privilege Clause
Use of Japale is a privilege, not a right. The application and its services are provided at our sole discretion. Any termination of access, for any reason whatsoever, shall not entitle the user to any form of compensation, refund, or legal recourse against the Company or its founders.
5. Anti-Circumvention and Ban Evasion
Attempting to bypass our moderation systems is a severe breach of these Terms. Creating alternate accounts after being banned, utilizing coded language to bypass automated filters, or using different email addresses/VPNs to evade IP or Device blocks constitutes a direct attack on our ecosystem.
We reserve the right to initiate legal recovery of costs for any disruption caused to our ecosystem by users attempting to circumvent our security or moderation measures.
6. User-to-User Disputes
Users are solely responsible for their interactions with others on the platform. Japale has no obligation to monitor personal disputes between users and assumes absolutely no responsibility or legal liability for personal conflicts, disagreements, or damages that arise from user interactions on the platform.
7. G3 Voice Chanting & Microphone Privacy
The Japale application includes a "G3 Voice Chanting" feature that requires access to your device's microphone. We strictly adhere to the following privacy principles regarding this feature:
- Explicit Consent: Microphone access is never requested automatically. You must explicitly grant permission prior to using the voice chanting mode.
- Session-Based Activation: The microphone is active only while the G3 Voice Chanting mode is in use and is immediately deactivated once the session ends.
- 100% Local Processing (Zero Storage): All voice data is processed entirely on your local hardware. We do not record, transmit, or store your voice data on our servers. Your audio data is transient and never leaves your device.
8. International Compliance and Jurisdiction
Our servers, operations, and administrative teams are based entirely in India. By using the App, foreign and domestic users consent to the transfer, storage, and processing of their data in India, governed exclusively by Indian laws.
Any arbitration, legal proceedings, or disputes that bypass the waivers stated herein shall be strictly subject to the exclusive jurisdiction of the competent courts in Bilaspur, Chhattisgarh, India.
9. Indemnification
You agree to defend, indemnify, and hold harmless Japale, the Sewak Community, and its founders from any loss, damage, liability, claim, or demand (including reasonable attorney’s fees) made by any third party due to or arising out of your violation of these Terms, your misuse of the platform, or your infringement of any law or third-party rights.
10. Amendments and Modifications
We reserve the right to modify or replace these Terms at any time at our sole discretion. It is your responsibility to review these Terms periodically. Acceptance of these Terms is obtained through explicit, affirmative action (such as checking an unticked box) during account registration, in strict compliance with the DPDP Act 2023. Material changes will require fresh explicit consent.
